Under the federal E-SIGN Act of 2000, electronic signatures are legally valid in all 50 US states. 47 states have also adopted the Uniform Electronic Transactions Act (UETA). New York, Illinois, and Washington have their own equivalent e-signature laws.

Liability waiver enforceability varies by state. Most states enforce pre-injury waivers if they are clear, unambiguous, and voluntarily signed. Notable exceptions include Montana (waivers generally not enforced) and New York (gym waivers void under Gen. Oblig. Law 5-326).

The age of majority is 18 in most states. Exceptions: Alabama and Nebraska (19), Mississippi (21). Minors generally cannot sign binding waivers without parental consent.
