ASSUMPTION OF RISK AND RELEASE OF LIABILITY: I understand that physical exercise involves inherent risks including but not limited to: musculoskeletal injury, cardiovascular events, dehydration, and aggravation of pre-existing conditions. I voluntarily assume all such risks. I certify that I am physically capable of engaging in exercise and have not been advised otherwise by a physician. I release the gym, its owners, employees, trainers, and agents from all liability for injury, illness, or death arising from my use of the facility, equipment, or participation in group classes. I agree to follow all facility rules, use equipment as instructed, and report any equipment malfunction immediately.

Not legally required in most states, but every gym should have one. Gym injuries are common — sprains, strains, equipment-related injuries, and even cardiac events. Without a waiver, you're fully exposed to liability claims for any injury that occurs on your property, even if the member was using equipment incorrectly.

A general gym waiver covers facility use, but personal training involves a higher level of risk because a trainer is directing the activity. Most gyms use a separate PT-specific waiver that covers the trainer's instruction and programming. At minimum, your gym waiver should mention group classes and personal training.

Your waiver should include cardiovascular event risk acknowledgment and a statement that the member hasn't been advised against exercise. You should also have AEDs (automated external defibrillators) on site and staff trained in CPR. A waiver alone won't protect you if you didn't have basic safety equipment available.
