The Photographer named above hereby grants the rights specified to the Client for the photographs described. Under "Full copyright transfer," all copyright ownership transfers to the Client, including the right to reproduce, distribute, display, and create derivative works. Under "Usage license" (exclusive or non-exclusive), the Photographer retains copyright but grants the Client permission to use images as specified. This agreement is governed by the Copyright Act of 1976 and is binding upon both parties' heirs, assigns, and successors.
Frequently Asked Questions
Copyright transfer gives the client full ownership — they can do anything with the photos forever. A usage license grants specific permissions (print, digital, commercial) while the photographer keeps the copyright. Most photographers prefer licensing because they can still use images in their portfolio and sell prints.
No. Under US copyright law, the photographer owns the copyright to any photo they take, unless there's a written agreement transferring it. Clients own the physical prints they purchase, but not the right to reproduce them. This surprises a lot of people and is why copyright releases exist.
It's standard practice and most clients are fine with it. Include a line in your release stating you retain the right to use images in your portfolio, website, and marketing materials. If a client wants exclusivity (no portfolio use), charge more — it costs you future business to not be able to show your work.
